Stuck in a Notice Period: Can I Legally Leave Early by Paying My Salary?

Hi all, I have been working with a Pvt Ltd. company for the last 3-1/2 years. My family resides in my hometown. I have recently been offered a new job in the same profile with a significant salary increase, and the new organization is willing to place me at my hometown location. I have submitted my resignation to my current organization, but it has not been accepted yet. According to my appointment letter, I am required to serve a 3-month resignation period. However, if I seek early relieving, I will have to repay my salary to the organization. Despite my desire for early relieving, the HR department insists on receiving approval via email from the Regional Head, who is currently unwilling to grant it. I am prepared to pay the salary in exchange for early relieving.

Could you please advise if there are any laws or legal actions that could facilitate my early relieving from the organization?

If the clauses of the appointment letter agree to the payment of 3 months' salary in lieu of the notice period, you have every right to leave the organization by paying 3 months' pay. First, write a letter stating your readiness to pay the salary and get it registered at your office. Then wait for their reply; if they are adamant about your relieving, send a lawyer's notice to them.
