We have 8 paid holidays (Annual Holiday Calendar) for our company. So, there was Ganesh Chathurthi as a holiday, and we, as company members, got a paid holiday for this day.

Obligations Under the Factory Act

1) Is it obligatory for an Engineering Company under the Factory Act in Pune, Maharashtra, to give paid holidays to contract workers in our company?

3) In the case of security guards who have to work 24/7, what is the principal employer, i.e., our company's liability to provide them with paid holidays?

You need to check with the Maharashtra Shop & Establishment Act. To the best of my knowledge, you need to follow an 8-hour, 26-day work regime. In case the person is on a contract and you wish for them to work extra, you need to pay them overtime at the minimum wage per day/8. Also, for every 20 days worked, you get a paid holiday. You need to provide them with SL & CL but no PL. The same applies to security guards. In case you call them on their weekly day off, you need to pay them double the wages. Also, most organizations have 10 days off in a year as per the Gazetted and restricted holidays list. If your work tends to suffer with a holiday like this, you can use the Compensatory off mode. Please understand that the Factories Act is not applicable here as they are contract laborers. So, the CLRA Act is applicable with Shop & Establishment.
