Starting Software Marketing: How Do I Draft Contracts with Developers and Clients?

kavi.bharadwaj@gmail.com
Hi! I intend to start marketing software products from small and medium IT enterprises. I need two formats of contracts:
1) With the development firm for whom I shall be marketing their products.
2) With the end user to whom I'll be selling the product.
Please help.

The Role of Commercial Lawyers

That is exactly what commercial lawyers do. They make contracts. Do you realize that even if you did manage to get a template from here (or anywhere else for that matter), and if you aren't a lawyer yourself, how large a risk you are exposing yourself and your organization to?

Customizing a standard CV template to suit oneself for a low-end or entry-level job is one thing. But, as an entrepreneur myself, reading your post sent shivers down my spine.

I can only suggest (the decision, of course, being yours) that you contact a commercial lawyer immediately—before you sell even one hairpin.

I realize the lawyer will cost you money—and perhaps as a 'startup', that is something you can't afford. But, let me ask you this question: 'In your quest to save some money now, are you prepared to expose your assets, funds, and business to potential risks should an incident (not addressed in your contract) occur later?'

Final Thoughts

In conclusion, once again, I urge you to drive a cheaper car, live in a smaller house, eat in all week (rather than go to restaurants), buy fewer clothes, don't go on holidays, etc. But DO NOT place your business or yourself in jeopardy before you've gotten off the ground.

But, the decision is yours! Good luck with your venture!
