Resolving Relieving Letter Issue: Experience Letter Request and Legal Settlement Advice

Hi all,

I worked for an MNC company for over 2 years, and I received a good offer from another company. I requested an early release as the company policy states a notice period of 2 months, with an option to pay a fee for early release.

Despite my willingness to pay the fee, the management is reluctant to grant me an early release. Following several discussions with HR and my manager, they still refuse to release me, although I have explained that I need to move on to join the new company.

After the 2-month notice period, my previous company sent me a letter demanding a certain payment. When I contacted them for my relieving letter, they insisted on payment before issuing it.

I sent a DD to settle the amount, and they sent me a letter confirming no outstanding dues after the payment. However, they only provided a letter of release and are withholding my experience letter.

Despite my attempts to reach out by phone, they continue to redirect me to HR, who requested an email. Unfortunately, there has been no response to my emails or calls after that.

Please advise on how to proceed.

I have all the email conversations that happened with my manager and HR, as well as access to the HR Portal where it shows that I can pay the amount to get relieved earlier. Please suggest to me how to file a complaint against them legally.

I understand your feelings. Please go to an advocate and discuss with him for a legal settlement; surely, he will help you to get your relieving letter.

Dear Sir,

The problem here is that your previous organization is not providing you with an experience letter for some reason. However, you do have your appointment letter from your previous organization as well as a letter stating that you were relieved on a certain date. I believe that should be sufficient to demonstrate your experience with the firm. Hopefully, the current organization is fine with it.

Was it an IT company? Do they only play with the employees?

Send a written request letter asking for an Experience Letter by registered post.
