Fired After Injury: How Can I Get My Dues Settled and Seek Justice?

mahesh_hyd
Hi Mahesh, I am from Secunderabad and worked in one organization as a technician for 15 years. Recently, while working, my hand got injured, albeit minor, but it is causing significant pain. Despite the discomfort, I completed my tasks that day. The following day, I was absent due to the continuing pain in my hand.

Due to my absence, the organization terminated my employment and appointed another person to replace me without any prior notice. Furthermore, they have not settled my full and final payment up to the current date. When I requested the settlement of my dues, they claimed that they owe me nothing.

I am unsure of what steps to take next and whom to approach for assistance in this matter. Your guidance on how to proceed would be greatly appreciated.

Thank you.

Why don't you speak to the senior person of that organization and tell him about the situation? Go to that office personally and speak to the higher authorities.

As per the statements quoted, an organization cannot terminate its employee without prior notice. If any, the employee will be informed, or the company is liable to pay at least one month's salary as compensation. Full and Final Settlement is followed when the above-said happens in a systematic way.

Please clarify whether you were given payslips every month? Were you paid for the last/current month of your working day before your termination?

Legal Guidance for Employment Termination

Your organization should have Standing Orders. If so, the termination process will be outlined there, and they must adhere to it. It is crucial to seek legal consultation for your issue, as you risk losing your valuable 15 years of service if no counteraction is taken immediately.
