PF claim - death case - what are the benefits she will get from pf office?

kanaka
Please tell me what forms are to be submitted to the PF office for a death case claim. One of our employees died last month. His wife submitted Form 19, 10C, 20, and passport-size photographs. Could you please inform me if there are any other documents I should submit? I would also like to know what benefits she will receive from the PF office.
Sadashiv Rao
Hi,

The forms are OK, but what about the death certificate? This is the proof that the employee is no more. The benefits that his wife will get is the Provident Fund amount that has accumulated in the deceased employee's PF account (employer & employee), or if he had opted for the pension scheme during his tenure of service, then she will get the pension benefit. Kindly cross-check with the Public Relations Officer in your local PF office. I hope the forms 19 & 10 C have been duly signed by the employer & submitted to the PF office. Hope this information will help you in resolving this case.

Regards,
Sadashiv Rao :)

Dear Kanaka,

In case of the death of an EPF member, the following forms are required to be submitted by the nominee/claimant with the Sub/Regional PF Commissioner's Office:

1. Form No. 20 (For Claiming EPF Contributions)
2. Form No. 10-D (For claiming benefits under the Pension Scheme, 1995)
3. Form 5 IF (For Claiming EDLI benefits under the EDLI Scheme)
4. Death Certificate issued by Panchayat/Registrar in original.
5. Photographs of Claimant(s) duly attested by the employer.
6. Proof of the date of birth of the claimant for pension benefits.
7. Photographs of minors (Max Two Minors) along with their birth certificates duly attested by the employer.
8. Form 5/10 duly signed by the employer.
9. Letter by the employer declaring the claimant as a legal heir if no nomination by the member has already been made.
10. Form No. 3A current year's contribution by the employee and employer.

In case of death (Married Person): The widow will receive the entire contribution made by the employee towards the EPF along with the employer's share of contribution with interest until the date of settlement. She will also be entitled to EDLI (Employees' Deposit Linked Insurance) benefits in the form of a lump-sum amount. She will be entitled to a pension throughout life, calculated based on the last drawn salary by the member. Two children will also be entitled to Children's pension under the Pension Scheme, 1995.

In case of an unmarried person: The nominee (father, mother, brother, sister) will receive the contributions paid by the EPF member. Father/mother will receive pension benefits under the Pension Scheme if they are dependent on the member.

Please let me know if you require anything else, and I can assist you in this regard.

Dear Anil,

Thank you very much for the detailed answer which Kanaka provided. This is very elaborate, and I am sure that it will help solve the individual's query. Your answer has also enlightened me as I was not aware of certain points since I am currently based abroad.

Thank you very much again.

Dear Sadashiv,

Thank you. I must say that the social security schemes enacted through statutory means in India are excellent. Almost every part has been taken care of while enacting the law. Unfortunately, these schemes are still not being implemented in their true spirit. The reason behind this is the awareness level.

Employers do not know the benefits they will receive if they implement the scheme, and employees are also not aware of the benefits of the schemes. Due to this lack of awareness, the contribution towards the fund is becoming more of a burden on both the employer and the employees. It is our duty to spread the awareness among the members of the scheme and also to the employers so that the security, which the law guarantees, reaches those concerned.

Dear Sir,

Please let me know if an employee has resigned from my company to join another company but is unable to withdraw his PF amount. Unfortunately, he has passed away, and his wife is now claiming the PF amount. Kindly inform me about the procedure and the documents required for settlement.

Dear Sir,

Please let me know if an employee resigns from their current company and joins another company but is unable to withdraw their PF amount. If the employee passes away after joining the new company, and his wife wishes to claim the PF amount, could you please provide details on the procedures and the necessary documents required for the settlement of the claim?

Thank you.

My query is this: if an employee left the organization and after two months have expired, but his PF is lying with the PF department and his service period is 3 years, is his nominee eligible for Widow pension or not.

Can you please tell me if one of our employees (unmarried) has expired? His nominee was his father; unfortunately, his parents are also no more. Is it possible that his brothers/sisters can avail of PF withdrawal? Please do suggest. Waiting for a reply.

PF Claim: Death Case:

Dear Sir,

I would like to thank you for the service you are providing through your website on EPF-related issues, etc.

I am a newly joined clerk, hence I need suggestions on the following issue. A Casual Labourer (Minimum Time Scale), who retired on 30-12-2013, was sanctioned a pension on 22-10-2014. While receiving the pension, she passed away on 20-11-2014. Her dependents are her husband, aged 73, and her son, aged 41. She did not opt for any return on capital as per her pension application.

So, my question is, what benefits will her dependents (husband & son) receive from EPF, and what are the necessary documents to be submitted to avail those benefits? An earlier reply to this query would be very much helpful to the grieving family.

Thank you, sir.

I have a query on this issue. If a member and their spouse die, who can claim their PF amount? If they have a minor child, can the child claim it? If yes, what is the process for that?

Please provide an update on the same.

Hi,

In case of an emergency, how can a widow withdraw PF if she wants to go abroad in such a situation?

Please let me know if you need further assistance.

My query is this: if an employee's service in an organization ends within one month, am I eligible to benefit from the widow's pension?

Dear Anil Anand,

Thank you for your nice and detailed reply to Kanaka. In that, you mentioned that all the benefits go to the wife after death. However, I would like to know more regarding the situation where the deceased individual was the only child, the sole breadwinner of the family, and recently married for only 10 months with no children.

In this scenario, what happens to the parents who were entirely dependent on their son? While the wife may remarry and establish a new life elsewhere, what about the elderly and aged parents who have lost their only son?

Regards

Dear Mr. Anil,

One of our known persons died during service 8 years ago. She was a widow, and her son passed away 2 years later. Now, her daughter-in-law is claiming to be the only legal heir for both of them (as per an affidavit). Could you please provide information on the procedure for claiming the settlement? Kindly let me know, please.

Dear Sir,

I want to know how to make a legal nominee for two dependent minor sons in case of the EPF member's death and if both the EPF nominee and the member have passed away. Both of the EPF member's sons are minors, and one is handicapped. Since his nominee, his wife, has also passed away, is it possible for his brothers or sisters to be considered as legal nominees?

Is it possible for the EPF to be withdrawn for the dependent sons and for them to be eligible for pension funds? Please advise.

Thank you.

Dear Sir,

Please provide a letter format from the employer declaring the claimant as the legal heir if no nomination by the member has already been made.

Dear All,

I need your expert advice on the following point: In reference to a death case, instead of children's date of birth certificates, can a BONA FIDE certificate issued by the school be considered valid by EPFO?

Dear team,

I have applied for the composite single death claim form for my brother. I have submitted the following documents:

1. Death certificate
2. Claimant Bank passbook attested copy (for PF contributions)
3. My father's bank passbook attested copy (pension scheme)
4. My family photo

I have also raised a GMS ticket for the PF status. I received the following reply from the PF office:

This is in reference to your Grievance registered under Registration Number SROSL/E/2019/00003. It is informed that after processing your grievance, the following action(s) have been taken:

With reference to your grievance, it is informed that the claim forms 20, 5IF, and 10-D have been returned due to the lack of a Legal heirship certificate or Family particulars, and a separate claim has to be filed by the claimant, etc. For further details, you may contact the employer and submit the claim at the earliest with all the required particulars as requested in this office letter. If the employer has refused to assist you or if you have additional queries or grievances, please email us at ro.salem@epfindia.gov.in or contact us via Toll-free number 180042532041.

Please, can you assist me with obtaining the above-required documents?

Can you please suggest to me if one of our employees (who is married) has passed away? His nominee is his wife, but he also has his dependent mother (a widow) who has not been nominated for pf/esi/gratuity.

Is it possible for his dependent mother to receive pf or pension?

I am waiting for a reply.
