Navigating LTA and Medical Claims: How to Handle Employer Disputes and Proof Requirements

amol.urkande
Dear forum, I joined the company in July 2005. I claimed the LTA in March 2006 and in December 2009. My queries are as follows:

1. Can I claim LTA (taxable) from April 2006 till date?
2. Can I claim medical expenses in a similar manner?
3. What steps can I take if my employer does not entertain the above requests despite them being in the agreement?
4. My employer has made it compulsory to submit proofs for claiming LTA/Medical, even though the Supreme Court ruling states that no proofs should be collected from the employee. In the absence of proofs, the organization will directly credit the amount in the salary, taxing it. How can this be avoided?

Thank you.

LTA in the Calendar Year

LTA is in the calendar year. You can't claim it twice in a calendar year. Proofs are required only if you wish to avail tax exemption; otherwise, the employer is bound to release the due LTA as taxable income.

Thank you.
