Greetings all. I am surprised by the lack of information or feedback on our site about hospital-related questions. So, please help all of us with the following queries:

1) Under which act does a private hospital come in Maharashtra - Shop & Commercial Act or any other?

2) What is the minimum wage applied for nurses and housekeeping staff in Maharashtra?

3) What statutory compliance and registers are to be maintained in hospitals in Maharashtra state?

Minimum Wages for Hospital Staff

2. For nurses, minimum wages should be for the skilled category, and for housekeeping staff, minimum wages should be for the non-skilled category.

Statutory Compliance

- PF compliance
- ESIC compliance
- Gratuity
- Pollution board certificate
- All registers to be maintained under the Shops and Commercial Establishment Act, Maharashtra
- Contract labor registration (if you hire contract labor).

There is no exemption for private hospitals in the ESIC Act. If the total strength of the hospital is 20, the employer must pay ESI contributions for all employees receiving a salary up to ₹15,000.

PrasoonSir, sorry to disturb you again. Please let me know if the below information is correct or not:

1) For a private hospital in Maharashtra, the minimum current wage (including DA) for unskilled workers is Rs. 3832.20/-, for semiskilled workers is Rs. 3932.20, and for skilled workers is Rs. 4032.20/- (zone III).

2) According to the rules, which wages are applicable for hospital employees? Is it as per the Shop Act or as per the hospital wage rate decided by the government? (The above-mentioned wages are as per the government notification.)

3) The main unit of the hospital is in Tamil Nadu, and the branch hospital is in Maharashtra; so, which state's wages are applied? It is a private limited hospital.

Minimum Wages for Hospital Employees in Maharashtra

In its circular dated 05/08/2011, issued by the office of the Labor Commissioner, Govt. of Maharashtra, the minimum wages for hospital employees are as follows:

- Unskilled: ₹3260 (basic) + ₹1783.50 Special Allowance = ₹5043.50
- Semi-Skilled: ₹3360 (basic) + ₹1783.50 Special Allowance = ₹5143.50
- Skilled: ₹3460 (basic) + ₹1783.50 Special Allowance = ₹5243.50

This is applicable up to December 2011.
