Though I agree with the views of Mr.John, who is having all interest in EPF & ESI ACTS ,even though not applicable in Austrlia,but I must appreciate the efforts of Mr. Arun Lokhande, who has given all the details in a simpler form.
However, I will advise that it will be wise to always browse the official web-sites of EPFO & ESIC for latest developments in their Acts & Schemes. Only in case anything is not clear, may be raised in these coloumns for seeking clarifications/clearing doubts.

Dear Dr. Ashok,
Previously I was working for a org which had deducted PF from my salary.
After some time the same management had started an organization which I had been transferred to the new organization.
As on date I had left the company for a better opportunity. When ever I ask for by dues they are denying my calls and stating that they are to submit the returns.
They have not given me any sort of evidence of payments to PF office except declaration in the Form 16 (ITR).
Can I proceed legally ? I shall be very much thankful for your guidance in the regard.
The previous company had stopped me in submitting the form 19 till dues are cleared

Dear Mr.Ramesh,I will advise for submission of Form 13 for transfer of your earlier account into your new estt.,s account. You might have declared before the new employer about ur earlier employment and membership of EPF and filled up the Form -2 also. RPFC will take care of all the non compliance made by the earlier employer. In case u r not having ur earlier account number, then u will have to make a complaint before the RPFC.
