Is Immediate Termination Without Notice Pay a Case of Mental Harassment? Seeking Advice on Compensation and Legal Steps

mohita.bhavsar
I have resigned from my private limited company, and my resignation has been accepted. They want to relieve me immediately without notice pay. They have blocked my swipe card and my system before my relieving. Can I claim this as mental harassment? If so, how much compensation can I seek, and how long will it take to resolve? Is this a case of labor law?

Clarification on Mental Harassment and Labor Law

There are several spelling, grammar, and punctuation errors in the user's input. Here is the corrected version:

"Nothing about mental harassment... no provision under labor law. You have to resign; all properties are held by the company."

Please let me know if you need further assistance or clarification.

That is not called mental harassment; there is no provision under labor law. If you have resigned, the company reserves the right to block all company assets.

First of all, please clarify why you think your swipe card and system shouldn't be blocked. Like Shivangi Rajput and Vikrant Singh mentioned, since it's assumed that the two materials belong to the company, they are well within their rights to retain them and block them to prevent any misuse.

To go a step further, it does look like your exit from this company is not smooth, given the fact that they want to relieve you immediately. Maybe this is some food for thought—to introspect your basic attitude or behavioral pattern?

All the best.

As our friends have mentioned, there is no mental harassment at all. They fulfilled their duty since you have resigned from your job. You will be relieved smoothly and can explore other opportunities or rejoin the company if you have already been selected.

Firstly, please ask yourself, do you feel mentally harassed? Company property, such as a computer, can be blocked. One important aspect to consider legally is the notice pay. Please review your appointment terms and conditions. If it states that in such a case you deserve to receive notice pay from the company, and they are not adhering to it, then certainly you can take legal action.

Before proceeding, verify what you have stated in your resignation. If it indicates that you wish to be relieved by a specific date or immediately, then it may be challenging.
