How Much I Can Claim If Company Is Ready To Relieve Me Before My Notice Period - Company Notice Period

I am working in software pvt. ltd. company. As per company's offer letter, employee has to give 2 months notice period before relieving and if company wants to relieve early, they shall pay 1 month salary for early relieving. I have resigned now and company wants to relieve me immediately but do not want to pay for 1 month notice period. How much can i claim 1 or 2 month legally? To whom can i contact for further advise?

how are you? Look mohit company has to pay the amount for 2 month B'coz you are right at your part ,u already served notice period as per the terms & conditions. But if company wants you to relieve,so its my advice no need to take step,which they create problem for you in near future so kindly collect your experience letter & one month salary b'coz they relieved you early. mohit may be i m wrong.

Dear Mohita,
If company wants to relive you early then employer is liable to give you 2 months salary as per mention in offer letter. Please read the offer letter cerefully if such clause is not mention then it's your Right to receive 2 months salary. If Employer is not ready to pay you then you may contact to Labour Officer.
Shefali if you are right then no one dare to create problem in your future.

Clauses mentioned in your appointment letter will be applicable. Hence employer must pay you one month salary.
If they are not ready to pay, you should write them a letter giving references of the clauses of your appointment letter. Get an acknowledgement of your letter and wait for your employer's official reply. Do not take any step in a hurry.
