Dear GRETTAPL,
greetings for the day,
Ask your friend to get the leave record of himself from the establishment by this only we can know the working days of the employee of the last 10 month if he completes the 240 days he must be eligible for the payment of gratuity if employer refuses to do so he is liable to be punished.

Thanks for your reply. Her joining date was 1st September 2006 and her last working day as per the letter given by the company was 15th June 2011. She was on medical [ESIC] leave for 15 days, before she could resign. This means that she has completed 240 days in the 5th year. We need a proof to show the eligibility to her last employer. Whenever she calls up for gratuity, they simply say that we have given your case to our consultant and as soon as we get the reply from them, we shall take action accordingly. They are just taking time, as she has left this job in the month of June and today we are in September.
