Comprehensive Guide to EPF Withdrawal Rules and Pension Fund Eligibility

shobhajarun@gmail.com
He quit my previous job within 5 months and is not working anywhere at present. I need to withdraw my PF, so can I?
shivam9992000
Hi Shoba,

You can withdraw your PF amount with at least six months of service in any organization. Since you were relieved 5 months ago, I don't think you are eligible for PF settlement. Seniors, am I right?

Thanks,
Shivam

Dear Shobha,

You have to fill PF withdrawal forms 10c and 19. Submit these forms to your last employer; they will send them to the local PF office after completing formalities from their side.
dineshrajendran
Hi Shoba,

I agree with Mr. Shivam, you are eligible to claim your PF amount only after contributing for a minimum of six months with the company. Therefore, it's not possible for you to claim your PF amount at this time.

Thanks and regards

Dear all,

She can't claim for employer contributions, but she will receive her own contribution. Please correct me if I am wrong.

Dear Shobha,

You can withdraw your EPF accumulation simply by filling Form 19 & 10C duly attested by the employer and then submit the same to the concerned EPF office. Your accumulated amount will be credited to your bank account within the specified time.

Dear Shobha,

As per my understanding, a person can withdraw Provident Fund amount even before completing 6 months, but he won't be eligible for Pension Fund amount.

Haris

Hi Shobha,

Haris is absolutely correct. You can withdraw your provident fund amount by filling Form 19, but you are not supposed to fill Form 10c to withdraw your amount in the EPS account unless you complete 6 months in your job. Make sure that you submit the withdrawal form only after 2 months of quitting your job.

Neetu

Haris is right. You can only withdraw your PF amount but not the pension scheme amount. Alternatively, if you join another company, you can fill in a PF transfer form (i.e., Form 13).

Hi all,

I am new to this forum. I happened to go through this discussion. My question is also related to PF withdrawal.

I had worked in an organization for about a year. After that, I moved to another organization; however, I did not transfer my PF. It's been close to 5 years now in my current organization. Can I withdraw my PF amount from my previous organization?

I heard that there are a few rules, like if I am currently employed, I can only transfer PF from my old to the new company. Is that true?

Seniors, please advise.
vinod_chauhan_2004@yahoo.com
Dear Shobha,

You can withdraw your PF by submitting Form No. 19 duly filled and signed by the authorized signatory of the company from where you left, at the EPF office. There is no need to submit Form No. 10-C for service less than six months.

Thank you, Praveen. I had previously attempted to transfer the PF amount, but it was never successful. When I checked with both my current and previous organizations, they each pointed fingers at the other, stating that the paperwork had gone missing somewhere.

Is there a specific timeframe within which this activity needs to be completed?

Hi,

I agree with Haris. You will not be able to claim your EPS in less than 6 months.

Yes, Shobha is eligible for Form-19 only. She can get the Form-19 amount.

Dear Haris,

Greetings for the day,

You are absolutely right that for the withdrawal of EPS accumulation, the service period must be not less than 180 days, i.e., six months. Below that, only 12% + 3.67% + interest rate should be paid to the employee.

Thanks & regards,

From,

Hi Shobha,

I am working as an HR executive for an IT company, and I look after PF matters. As you mentioned, you have completed five months of service, making you eligible for a partial PF withdrawal. Kindly inquire with your company's PF agent.

You have been working for less than six months, so you are not eligible for a pension amount, but you are eligible for a provident amount. You need to fill out PF withdrawal form 19 and submit this form to your last employer. They will then send it to the PF office after completing the formalities from their side.

Thank you.

Hi all,

I have a question... How can I get my PF amount without my previous company's concern?

Regards.
mumtazmba
You can withdraw your amount by filling Form 19c. Form 10c is for the pension scheme you are not eligible for. Therefore, you can withdraw the PF amount. If it is less than Rs 2000, you can also receive that amount by post after submitting Form 19c. Within 40 days, you may receive the amount. Take care.
skumargiri
You can claim your PF amount, but you are not eligible to claim your pension fund because it requires a minimum 6-month contribution to claim.

Hi Shoba,

As Neetu said, you can withdraw your PF accumulations even if you served for one month (because that is your money). That means the amount recovered from your salary will be returned along with the prevailing interest rate as per the PF Act. Whereas the equal amount of company contribution will not be returned if you have not served a minimum period of six months. Out of the company contribution (12%), 8.33% will go to the Pension fund and the balance 3.67% will remain in the PF fund. If anybody withdraws the PF amount without serving six months, their PF amount + 9.5% (present prevailing rate of interest) interest + 3.67% of the company contribution + 9.5% interest will be refunded. The 8.33% of company contribution will be retained by the PF authorities because of administrative difficulties.

For this, you have to file Form 19.

Sorry seniors if I'm wrong.

Eligibility criteria for 6 months is only for Form 10C, not for Form 19. You can claim your provident fund even for a single day.
KRISHNAKALI
You can definitely withdraw PF even if you have worked for five months, but you cannot withdraw your pension unless you have worked for six months.
ramshewale
Hi Shobha,

What Mr. Harries says is absolutely right. You are eligible to withdraw but won't get the amount accumulated in the pension account. For that, a person should work a minimum of 6 months in the organization, which you have not done.

Hi Shobha,

Mr. Harish is absolutely right. You can only withdraw your provident fund, except EPS, if you are not in service for the last two months after leaving the service.

Thanks and regards,

Hi, Dear,

You can withdraw your PF amount. This is not a hard and fast rule that you have to transfer the amount. Since you won't get the employer's contribution, it is advised to continue your account with your present organization. Seniors, hope I am correct.

Hi Shobha,

You can withdraw your PF. Even if you worked for just one month, you are eligible to withdraw.

Hi friends,

In my organization, one employee has passed away last month. Which documents are required to be submitted to the PF office?
singhjyoti17
Dear Bhamare,

In the event of the death of a member:

Forms for claiming benefits under the Employees' Provident Fund Scheme - Form No. 20, to be filled by a nominee/family member to claim the member's Provident Fund accumulation.

Forms for claiming benefits under the Employees' Pension Scheme '95 - Form No. 10D, to be submitted by the first claimant, i.e., member, widow/widower, orphan, or nominee as the case may be. You can download the form from the link below:

My name is Prashanth, and I worked with an organization named 3Edge Solutions, Chennai (Tra Augment People Solutions) as a soft skills trainer for a couple of years. They are not paying my PF amount, and whenever I call the HR, she acts as though the issue would be settled ASAP and speaks the same way. However, this issue has been pending for 2 years now. I am not able to understand what to do. Can someone please suggest if there is any other way that I can retrieve my amount? They claim that because I was on Leave Without Pay (LOP) for two months during my tenure with them, the PF office has requested the reason for this. I have already submitted the required letter to them about the same, but this process isn't progressing. Please suggest what I should do. I even have the payslips. Is it advisable to file a case against the company as my uncle is a lawyer? I sought advice from him, and he mentioned that filing a case is the last option.

Regards,
Prashanth
