The formalities for ESI require a minimum staff strength of 20 employees, regardless of whether they receive a salary above or below 10000/-. The maximum ceiling for ESI contribution is 10000/- gross per month. Employees earning 10001/- or more are exempt from ESI contributions.

Employers must register their factories or establishments with the ESI Corporation within 15 days of the ESI Act becoming applicable. The registration declaration should be submitted in Form 01, including a separate sheet with the establishment's name and address, the number of employees, their duties, and the name, designation, and address of the managing personnel for offices located elsewhere. Upon approval, the ESI regional office will assign a code number to the employer.
Subsequently, employers can register their employees with ESI. Employees must complete a declaration form, FORM 1, indicating their gender. All declaration forms must be countersigned by the employer.
A separate return of declaration in Form 3 should be prepared for male and female employees within 10 days of submitting the declaration form.
Each employee will then be assigned a temporary identification number.
