How Do I Handle Termination and Compensation for a Non-Performing Employee?

I am working in an IT company, and I am handling HR. I have a query regarding an employee who has not been performing well for quite some time, and my boss wants to terminate him. Please guide me on drafting the termination letter, the process for termination, and information regarding his payment, such as whether to provide notice pay or any other compensation. I urgently await your reply.

Steps to Address Employee Termination

Issue him the show cause notice initially and then proceed with the termination and F&F settlement.

Send a notice to his residence asking him to report within a specific time and mention that failing to do so will result in automatic termination from that date. Wait for the reply. In case of no response, send a termination letter on the date he is terminated and settle his F & F.

We agree with the issue, but in any case, a notice, i.e., a show cause notice, shall be given stating the following facts:

1. Reasons for the continued and unauthorized absence.
2. Such acts cause loss of work, revenue, project delays, and further scheduling of the projects.
3. Time limit for responding to the show cause notice.
4. Termination if not joined, and further actions.

In case the employee does not turn up, you may discharge him from the services with immediate effect.

It depends on the terms of employment whether to pay him the notice period on termination. Please find the formal format of the letter as requested by you attached.
