Relieving Letter & Experience Certificate

Hi All,

I too have a similar problem as many on this forum have posted..about not getting Relieval and experience Certificate from the employer with only a small difference hence need guidance from the experts.

My previous organization had 2 Months of Notice Period, but the new offer I got would have expired in 2 weeks (I offered to pay in lieu of shortfall in the Notice Period but was refused on the basis that Company Policy can not entertain an exception in this clause) ..so I resigned from the organization, my resignation was accepted stating my last date to be 2 months hence. However I left the organization after 2 weeks after mailing my managers. Even then willing to settle all my dues.

Later we exchanged many letters and finally they sent me a full and final settlement letter which includes Notice Pay in lieu of shortfall. and on completion of settlement I ll get Experience Certificate only and that too would include the clause stating that I absconded from organization and hence wes terminated and therefore no relieving as well.I am still ready to pay but would like to have clean Experience & Relieving Certificate.

Now My questions is when there is a clause in our Policy regarding Notice Pay in case of shortfall and handing over both relieving and experience once dues are cleared ..why I am treated otherwise.For this they have only one answer that because my exit was not normal they can not relieve me.However I did offered to complete Project transition and all the settlement before my resignation but wanted early relieval.

Kindly let me know how I should proceed further from here.
