Stuck After Serving Notice: How to Handle an Employer Refusing to Release You?

Now my employer refuses to relieve me after completing a 23-day notice period. But my new employer said that I must join on August 16th at my new company.

In this case, what should I do? I have a copy of the accepted resignation and a copy of the email requesting an acknowledgment letter to HR. What legal action should I take against them?

If you have received an acceptance of your resignation, it puts your process in progress. However, please email the employer, offering any kind of buy-out, if applicable. Make sure you include an end date for your release. Complete all your formalities, including the knowledge transfer and financial declaration, respectively. Remember to remain polite but firm.

Finally, you may consider declaring that, in case no reply is received from them after the due date, it would be taken as clearance.
