Confused About Bonus Eligibility: Gross vs. Basic Salary Under 10000? Need Urgent Help!

Bonus Eligibility in the Chemical Industry

I am working in the chemical industry in Ahmedabad and have a question regarding the eligibility for a bonus. Our consultant mentioned that a bonus is eligible for those whose gross salary is less than ₹10,000 per month. As per the direction of the Gujarat High Court judgment, all allowances are included in the eligibility for the bonus.

So, is this correct or wrong? I believe the bonus is payable to those whose basic salary is less than ₹10,000.

Bonus Calculation and Eligibility

The bonus ceiling is set at ₹10,000 basic only. Any salary exceeding ₹10,000 will have the bonus calculation limited to ₹3,500. For salaries/wages exceeding ₹3,500, the actual calculation applies, while for wages of ₹3,500 or less, the calculation is different.
