Gratuity Eligibility and Formula

The employee who has more than 4 years and 8 months of working experience is eligible for gratuity. The maximum gratuity amount is Rs. 10,00,000.

Gratuity Formula

Gratuity formula: 15/26 * number of years * basic

Hi all, one more formula I have for gratuity is: gratuity = basic salary * 4.81 * 12 * number of years / 100. A person can be eligible for gratuity after completing 4 years and 266 days.

Eligibility for Gratuity

Persons who have completed 4 years and 6 months are eligible for gratuity in an organization. The formula has already been mentioned.

We have one employee who has worked with us for more than 6 years, starting from the year 2008. He was absconding/on leave without pay (not working in the field) during that time. In 2011, we dismissed him, and his last date of record is 30th June 2011. My query is, can we calculate his continuous service until his date of record (i.e., year 2011) or until he actually worked, i.e., in the year 2008?

The calculation has to be made until the date of his dismissal. If you take into account his date of retirement, which I presume is subsequent to his date of dismissal, you would be paying gratuity for a period during which he was not in your employment.
