Leave Facilities For Contractual Labour

Hi,
Our University at Pantnagar Uttarakhand is employing more than 3000 unskilled, semiskilled, skilled contractual workers through contractar.
May I know that which leaves these contractual workers are entitled for.
What facilities should be given to these workers.

Apart from leave,
The contractor needs to also give them washroom / Toilet facilities
and canteen facilities.
(please see contract labour regulation and abolition act for details of all things that need to be complied with)
If the contractor fails to do it, then you as the principal employer needs to provide it.
In addition you need to ensure that ESI and PF is being deducted and deposited with the authorities
Further ensure that they are getting minimum wages as notified by the local government. Also you need to ensure that overtime wages is paid at twice or normal rate for overtime work (more than 9 hours a day or 48 hours a week)
You (meaning a person nominated by the employer to be his representative) needs to be present during payment of wages and must certify on the Muster Rolls of the contractor that the wages are correctly paid in your presence.

There different registers for all the above payments. Please note failure to comply
with the above rules and regulations will ONLY make the Principle Employer, in this
case, your UNIVERSITY, solely responsible and not the contractor. Hence it is
absolutely, essential to ensure the pf and esi contributions for all the workmen
presently working for you are remitted every month and the payment challan
copies are submitted to you. It is normally recommended that unless the challans
for the previous month's pf and esi contribution (both the employee and the employer)
payment are provided further payment of the contractor's bill with be withheld.

Hi,
Three doctors are working at G.B. Pant University Hospital for last 10 years on fixed salary against vacant posts. They are been paid salary by cheque. One day break is given to them after every one year. No bond has been filled by theses doctors and no appointnent letter has been given to these doctors.
Can any body tell about claims of these doctors. How can these doctors claim for regular services.

We go a step further.
In cases where contractor has employees other than those posted in our clients location, we ask for copies of quarterly pf returns to be given (duly acknowledged by pf Dept) to ensure that the pf paid is for employees posted there.
We have had a few cases where it turned out that the payment was for employees other than this posted at that location and the principal employer had to pay the difference and penalty.

I think the doctors would be deemed to be permanent employees. One day break makes no difference.
