Stuck in Notice Period Limbo: How Can I Get My Company to Release Me?

I have submitted my resignation letter, providing a 23-day notice period to my company. The remaining days will be adjusted from my salary.

Probation and Confirmation Details

In the appointment letter, I was given a 6-month probation period, followed by confirmation. However, I have not yet received the confirmation letter. During the probation period, the notice period is 1 month, and after confirmation, it is 3 months.

Issue with Release

My company is not releasing me now. What should I do? I am willing to pay for the remaining days of the notice period as mentioned in the resignation letter.

From your post, I understand that you are still on probation until you receive your confirmation letter. Please take the company authorized signatory's signature to confirm that they have received your resignation letter. You will be relieved on the particular date mentioned. The acknowledgment would serve as good proof.

Apart from that, is there any clause in your appointment letter stating that only a letter of confirmation will deem you a confirmed employee? If not, then a 3-month notice period applies to you.

Now my employer refuses to relieve me after 23 days. As mentioned above, I must join my new company on 16th August. In this case, what should I do?

I have a copy of the accepted resignation letter and also a copy of the email requesting an acknowledgment letter from HR. What legal action should I take against them?
