Notice Period Dilemma: Should Final Settlement Be Based on 30 or 31 Days in June?

Dear All, As per the notice period service clause in the appointment letter, an employee is supposed to serve a 1-month notice period. Now, if an employee resigns in the month of June, then his full and final settlement calculation will be based on 30 days or 31 days in the month. In case he has served a 10-day notice, then should the recovery be calculated on the remaining 20 days of the month or 21 days? Please help me with this.

In the notice and compensation matter, we use the calculation based on thirty days. This has been our practice for the last 10 years. I cannot comment on the legal aspect.

Dear Chaityparna,

Always use a calendar month, meaning 30 days, and it does not depend on the resigning month. If the resignation is in February, then we cannot calculate notice and other compensation based on 28 days, so the month means thirty days, boss.
