Navigating Compensation After a Tragic Workplace Death: What Can the Family Expect?

Hi Seniors, my query is, if a person worked in an organization for 4 months and died on the job within the office premises, what compensation can his family receive? He was 52 years old, and his PF was not deducted from his salary, but he was a member of PF for the last 25+ years. Re 1 was deducted for 4 months as an employee welfare fund. Also, his PF amount in his previously employed organization is still in his PF Account.

Eligibility for Compensation

My query is, if his family is eligible for PF Pension, gratuity, or any other compensation, what steps should his family take?

He will receive the PF amount and pension. If your organization is under ESIC or Workmen Compensation, the employee's family will receive funeral expenses and other benefits. They will also receive benefits from the Labor Welfare Department. Additionally, the company will provide compensation.

His wife will receive PF, EDLI, and a pension from the RPFC. She must obtain a legal heir certificate and apply using the following forms for claims under the EPF Act in RPFC:

- Form 5 (IF) - EDLI
- Form 10D - Pension
- Form 20 - PF Withdrawal

Please enclose address proof, ID proof, and a canceled cheque along with those applications.

Gratuity may not be applicable as he has not completed 240 days, but it can be paid for one year by considering that he has worked for one year.

Thank you for your suggestions. However, in his last organization where he passed away, his PF was not deducted. The PF amount is currently held in his previous organization's PF account. What processes should we follow to claim this money? He had worked in various private companies across different states such as Punjab, Haryana, and Himachal Pradesh since 1997 until July 2009.

Subject: Gratuity

Gratuity is only payable after continuous service of at least six months in the case of death. In this situation, the person is not entitled to gratuity as per the Act.
