Starting My Own Placement Consultancy: Do I Really Need MOA & AOA? Can Anyone Help?

Hi friends, I am Roopkumar from Kolar, Karnataka. I have around 5 years of experience in HR placement services. I have good contacts in 4-5 sectors. Now, I have started my own placement consultancy. Can anyone help me with MOA & AOA? Is it mandatory to do this?

Dear Roop, it depends on whether you are going for a sole proprietorship, partnership, private, or public company. In the case of a sole proprietorship and a partnership firm, you don't need to go for a Memorandum of Association and Articles of Association. Both MoA and AoA are mandatory for public sector companies, and private companies also opt for these considering they may go public in the future.

You have to clarify what kind of company you are going to register. Is it a sole proprietorship, partnership, or private?

Hi Krishna, I also have the same doubt. I am registering my company under the Shop & Establishment Act as a Sole Proprietor. However, when I am submitting the form, it is asking for the MOA. How can I obtain this? Can you guide me?
