I am reproducing below the clarification to my query on amendment of Registration Certificate under Contract Labour (R&A)Act,1970 published in June’07 issue of LABOUR LAW REPORTER under column “ HR-Workplace Solutions”
“Q. While outsourcing security services we need our original registration certificate to the concerned authority for amendment all the time of extension of their service period which normally happens four times in a year because initial contract period is of three months at one time. Since no. of security guards remain same, would it be legal for us to simply notify the extension of contract period to the authority without sending them the registration for incorporating amendment ?
A. NO ! Under provisions of contract labour (R&A) Act, you are under obligation to get your registration certificate amended in case of either change in the number of contract employees or extension of contract period. Simply notifying the extension of contract period without getting proper amendment in the registration certificate will not hold valid. I suggest instead of extending the contract every quarter, you may have the contract for a period of one year to avoid the hassles of sending the registration certificate for amendment time and again whole the year. By having contract at least for a period of one year you will only be required to get your registration amended once in a year. You will save time and money both by this way.”
