Is It True That ESI Deductions Must Continue Until September Even If My Salary Exceeds the Limit?

Now my salary is Rs. 15,015/-, which is above the ESI limit. However, my HR manager mentioned that, according to the rules, if we deduct ESI in April, we must continue to deduct it until September. Is this true?

Why did he deduct ESI when your salary is more than the ceiling? Did you get this salary increment in May/June?

Hi, my salary has crossed 15,000 Rs per month, but ESI has been deducted (Rs 315). I heard that if the salary crosses 15,000 Rs per month, then ESI cannot be deducted. Can anyone please clarify why the ESI has been deducted?

Hi, my increment was done in July 2011 and crossed 15,000 Rs, but ESI (Rs 315) was deducted from my July salary. I heard that if the salary exceeds 15,000 Rs per month, ESI cannot be deducted. Can anyone please clarify why the ESI has been deducted? If there is any link or attachment regarding the ESI amendment, could someone please attach it? Thank you.

The ESI return submission cycle is half-yearly, from April to September and October to March. As per your statement, you received an increment in July 2011. You are in the return submission cycle period from April to September. According to the ESI Act, if ESI is not deducted for a month in any cycle, the employer must pay ESI for the entire six months, even if the salary exceeds the limit of ₹15,000 in July of that cycle. Your ESI will not be deducted from October 2011 onwards.
