New Startup in Manufacturing: How to Legally Hire Security Guards on Payroll in Pune?

If the company wishes to engage all security personnel from the beginning (as the company is a new start-up) on its payroll, then what permissions and exemptions does the company have to seek?

The company operates in the manufacturing industry in Pune, Maharashtra, with a staff strength of around 100 personnel.

Watch and ward staff can be engaged directly, and the procedure is similar to that of other employees.

There is no restriction and no specific approvals required for the deployment of security personnel on company rolls. For every process, there will be pros and cons, as is the case here as well.

Security Personnel Deployment Strategy

I suggest going for one senior person like a Security Officer or Incharge from the company to take care of all security and administrative activities from the company's side. The remaining staff, such as security guards and supervisors, can be arranged in shifts through a contractor. This approach helps the company reduce financial implications. If the company's employees opt for unionization, there is a chance that security personnel may also join the union. Additionally, there is a possibility that security guards may take a lenient view on the employees if they are directly employed by the company. Therefore, a mix of company-employed and contract personnel is advisable.

Dear Prashant ji, if you are engaging your own security personnel for your industry, they will be coming under your rolls. If you are providing services to any private security agency, they are covered under the Contract Labour Act. However, in some states, private security agencies fall under the purview of Minimum Wages (e.g., Andhra Pradesh). In that case, even if you engage contractor services, you must adhere to the Minimum Wages as stipulated by the respective state governments' schedule of employments. Dear Prashant, I suggest engaging an outside security company with strong credentials as they would be better equipped to handle any situation that may arise. It is important that they adhere to guard board pay scale compliance.

It is rightly said by kraos_1954 that you can recruit one person in the rank of Security Manager/Officer who should be well-versed in the latest security systems, gadgets, implementation, and other people can be outsourced. This would reduce your risk of providing all the perks and benefits as per company rules. Security personnel in any company do not join the strike, even though they are members of the union.
