Concerned About Tax Filing? How to Handle Missing Settlement Details in Form 16

rashlikesu
Hi, I left my company in November 2010 and received my last two months' salary as full and final settlement in January 2011. However, the amount I received in the full and final settlement is not included in the Form 16 I have received from them. Ideally, there should not be any refund, but if I use my Form 16 to file my return, I am getting a refund of $3,000. I am concerned it may appear fraudulent. Should I include the amount I received in the full and final settlement in my tax return or ask my previous company to reissue the Form 16 they sent me?

No need to hire any CA for the tax refund. Please let me know if this refund is for the period 10-11 or for 09-10. Please note that the IT Department will definitely refund your tax, but it will take some time.

Most of my friends have received their refund checks for the financial year 08-09. So, I would suggest waiting or writing to the IT Department.

Thank you.

You can cross-check with your previous organization regarding your IT deduction. Normally, your IT deduction is made from the beginning of the accounting year. If the deduction exceeds, they may not remit it from your full and final settlement. Please check with the concerned department.

Note:
1. You have to collect Form 16 from the concerned department.
2. Voluntarily, you can show your income.
