Am I Eligible for Gratuity After 4 Years and 6 Months? Seeking Advice on Company Policy

shalombaria
Hi All, I have completed 4 years and 6 months in my current organization and have now resigned. Some seniors mentioned to me that a person with 4 years and 6 months of experience is eligible for gratuity. I just wanted to check if that is correct because my company refused to pay me the same since I have not finished 5 years. Please help.

Best Regards,
Shalom

Dear Shalombaria,

To be eligible for gratuity, you need to complete a full 5 years. However, once you are eligible, 6 months or above is treated as one full year.

Since you have not completed 5 years or 4 years and 240 days fully, you are not eligible for receiving gratuity. Treating 6 months as a full year will not be applicable in your case.

Thank you, Mr. Alphonse. However, I read about a similar case like mine, and I have come to know that the court has approved the payment of gratuity. Thank you for the information.

Shalom
