What amounts will be included while giving the retrenchment compensation?

Hi to all
1. The workman was initially employed on fixed term contract for one year, after completion of that one year, he was given regular appointment. today he is retrenched, the Employer is ready to pay retrenchment compensation. While calculating the Retrenchment compensation will that one year of fixed term service will be taken or not??
2. What amounts will be included while giving the retrenchment compensation? will it include HRA, Medical, LTA, CCA, Conveyance allowance, special allowance.?
3. The contract of appointment states that he will be paid "gross wages" and a break up also is given. Will the retrenchment compensation be paid on these "gross wages" as given in his contract?

The workman worked in contract period will not attract any compensation and for that on completion of the contractual period itself he might have been paid by the company.
The Retrenchment compensation, Notice Pay, Leave Pay, Gratuity everything are made on the Basic and not on Gross or not on CTC or not with other allowances.

The appointment letter issued to the individual at the time of contract appointment and the appointment letter issued subsequently have to be read to formulate any views on the issue raised by you. For calculating retrenchment compensation the definition of the term "wages" as defined in the Industrial Disputes Act 1947 has to be followed. Please go through the section. For calculating gratuity the basic pay plus dearness allowance if any have to be reckoned. For notice pay and leave pay, the gross salary has to be reckoned.

Hi, What should be the terms & conditions if any fresher has to be hired for one year training session and after that their service get confirmed with bond of three years.
