Is Form 16B Necessary If My Income Wasn't Taxable? Seeking Advice from Peers

shilpivi
Can anyone please tell me if someone's income is not taxable, is it necessary to provide Form 16B? I was working with one company from May 2009 to October 2010. Now my current company is asking for Form 16B.

Even non-taxable category people have to file returns. I think Form 16 shall be issued irrespective of his/her income in the taxable limit.

Shilpi,

They are supposed to provide a service certificate wherein your salary details will also be mentioned. On request, service certificates are issued by past employers. Approach them with your written request.

The company will provide you with a salary certificate if your net taxable income is below ₹1.8 lakh per annum; otherwise, a Form 16 is required if any TDS was deducted from the salary.

Income Tax Filing for Salaried Individuals

From the assessment year 2011-12 onwards, salaried persons earning up to Rs 5 lakh per annum would not have to file IT returns. The Form 16 issued to salaried employees will be treated as the Income Tax Return. The idea behind the move is that in cases where there are no other sources of income, filing a return is a duplication of existing information. Therefore, if the salary is taxable and there is any TDS, the employer should issue Form 16.
