What Can We Do If an Employee Leaves Without Completing Their Notice Period?

Dear All, One employee has been working in our company for the past 4.3 years, and he resigned yesterday, requesting to be relieved on 16th June-11. However, according to company policy, he is required to serve a notice period of 2 months. It is not possible for the company to relieve him before the completion of this notice period. Although the option to buy out the notice period is mentioned in our appointment letter, we prefer not to exercise this option as we require his services for the full 2 months.

If the employee goes absconding after the 16th, what actions can we take against him?

Handling Employee Resignation and Notice Period

In such cases, don't accept the resignation. Send him a notice to join duty immediately. Failing which, you can recover the notice period amount or the amount you consider to recover from him in the event of his non-performance of the notice period, considering it as a loss. It can be recovered through a civil suit.

Notice Period and Relieving Process

As per the provision of your company, an employee must serve a notice period of 2 months. If he/she has requested their supervisor or concerned authority to be relieved without serving the notice period and if the application is accepted, then he/she may quit the organization without serving the notice. Otherwise, they must serve the notice period to obtain the relieving letter, claims, etc., from the resigning organization. If he/she doesn't serve the prescribed notice period, the employee shall not be properly relieved, which may cause trouble for their future career endeavors.
