Are We Legally Required to Pay Stipends to Industrial Trainees? Seeking Your Insights

Dear All, I would like to seek your valuable opinions on the below-mentioned query. We are accommodating a few diploma 5th-semester students for their Industrial Training curriculum for 6 months at the request of the college principal, without paying any stipend (as clearly mentioned in the terms and conditions) to which they have agreed. We are providing them training in various departments.

Obligation to Pay Stipend

I want to know if there is any obligation to pay a stipend for the Industrial Trainees. If yes, please refer to the clause(s) and the act(s) related to this topic.

Thanks for your consideration, and I look forward to your valuable responses.

In India, the obligation to pay a stipend to industrial trainees is governed by the Apprentices Act, 1961. According to this act, if the training period exceeds three months, stipends must be paid. Since the students are undergoing training for 6 months, it is advisable to provide them with a stipend to comply with the legal requirements. Failure to do so may result in non-compliance with the Apprentices Act, which could lead to legal consequences. It is recommended to review the specific clauses of the Apprentices Act, 1961, to ensure full compliance with the stipend regulations for industrial trainees.
