I Am Receiving Notices From My Previous Organization- Please Help Me.

rama_2011
Hi,
I Joined in one IT Organization on Feb 2011,and left that in May 2011.with out intimation.
Because of the following reasons.
1) Forced to attend Late night Calls.
2) Insecurity in job(Terminating Employees Suddenly/ Not issue of Original ID Cards/Not providing the Correct Original Offer Letter(i.e) comp address on the Offer Letter is not where the comp is.)
3) Not fulfilling the Promises given( Technology/ Project) at the time of joining..
after a Week I left The org,i send a resignation letter with a clear explanation of reason for leaving.
even though i am receiving notices from the organization by treating me as a abscond. what should i do, do i need to take the notices from the company or reject it. please Help me.

Dear Rama
firstly read out all the instruction given on appointment letter.
are you havind appointment letter on which wrond address is printed, and whether it is mentioned for night shift or not,
and have you signed any contract with company.
If all these issues are ok. Then you need not to accept notice. just remind them that you have already resign on ....date. Moreover you can attach photocopy of your resignation letter.

Dear Rama,
Once you have submitted the resignation (By E-mail / By Regd. post with AD) you need not have to get worried.
But as suggested by Mr. Sourabh, you should go through your appointment letter once again & should check about your notice period in the organization also.
For future, be careful. Before accepting any offer, you should check about the organization, their nature of business & other legal benefits like PF, Appointment letter, Leave policy etc.
It's my personal experience and I had already faced such problems in ealier days of my Career.

Dear Rama,

The right course of action would have been complaining about their corrupt labour practices to the local Labour Commissioner. fortunately the same is available with you right now also.

Do one thing write a letter to the Management with a copy to Local Labour Commissioner stating the above corrupt practices done by your previous employer. Also attach a copy of your resignation, appointment letter, notices from the company and ID card with the letter. This will help you in many ways. The company will stop harassing you and the action will be taken on them by the Local Labour Commissioner. But keep this in mind whether or not they have put their registered address on the Cards and other communication while keeping their corporate office address aside. they can do the same. so before taking any action against them you should be extra cautious so that the action do not backfire upon you.

Best would be the scanned copies of the documents on my Mail on [Login to view] in order to form any opinion.

thanks

Hi Rama_2011,

You have stated in your query that you left the organisation in May 2011 without intimation;

This is not the proper way to exit an organisation.

To obtain a clean exit from any employer, you would have to:

1) resign and serve the notice period specified in your offer/appointment letter.

2) resign and tender the notice pay in lieu of serving notice period and thereafter get yourself releived.

To leave an organisation without intimation would be construed as abandonment of employment for which you are liable to be terminated from the Company. The result would be a stigmatic exit from an organisation which could affect your future employment prospects.

Rejecting notices received from your employer is not a good option unless you wish to be faced with an order of termination which is most likely to follow the reminders you are receiving now.

You may reply to the letters or meet the HR of the organisation personally and seek a clean exit with a relieving letter after tendering the notice pay, if it is so provided in your offer letter; since you are not interested in rejoining the organisation.

The notices that you are receiving from your previous company is probably their way of formalizing the severance of the employee employer relationship. The suggestions given by the other members are correct. You should review the contract and check if there are provisions regarding resignations.
