Navigating Temporary Staffing for Government Contracts: What Documentation Do We Need?

Dear All,

I am working with a management consultant in the field of permanent recruitment services. We have recently secured a government contract for temporary staffing in the accounts division.

Could someone please advise me on the necessary documentation we need to handle on behalf of our corporate clients? This includes forms, challans, PF, ECS, etc.

Your immediate assistance is greatly appreciated as we have a meeting scheduled with them tomorrow.

Hi Mukta,

The following things need to be taken care of:

1. Employee Provident Fund (EPF) Registration
2. Employee State Insurance (ESI) Registration
3. Professional Tax Registrations

All of the above are mandatory. Please let me know if you would like to know anything else.

For EPF Registration, the following documents are required:

Employer Form 5

Employee Form 2

Payment of ESI before the 25th of the Next Month through the attached challan.

For ESI Registration, the following documents are required:

Employer Form 1

Employees must submit a declaration form along with Form 3

Nomination of family member Form 1a

Changes in family member Form 1b

Employee Registration Form 7

Payment of ESI before the 15th of the Next Month through the attached challan.

For Professional Tax Registration:

Employer Registration Form 1

Employees Registration Form 2

Payment of PT before the 15th of the Next Month through challan Form 5

Kindly keep in mind the following facts:

1. Who will be his employer - your company or the principal employer who has entered into a contract for staffing?
2. Whether the nature of the job is perennial or not.
3. Whether the job is perennial or not, the appropriate government i.e. labor commissioner will decide upon your request.
4. Why you or the principal employer is retaining temporary staff.
5. In case you are retaining temporary staff, submit Form IV along with Form V issued by the principal employer and apply before the appropriate government for the issue of permission in Form VI.
6. In case the principal employer is retaining temporary staff, he will follow the same procedure. He will approach his principal employer, which is the company who has awarded him the contract.
7. For more details, refer to the CLRA Act. The act is applicable for both private companies and government organizations.
