Hi, one of my friends is 8 weeks pregnant. She is volunteering and planning to go for an abortion due to some issues. Please suggest if she is eligible for maternity leave. If yes, how many days of leave is she eligible for? Please revert at the earliest.

According to Section 9 of the Maternity Benefit Act, 1961, she is entitled to have leave with wages at the rate of maternity benefit for a period of six weeks immediately following the day of her medical termination of pregnancy.

Eligibility for Maternity Benefits Under the MB Act

Note that any forceful abortions without the consent of women, which come under IPC, are not eligible for benefits under the MB Act.

No, here IPC doesn't apply. I agree with Archana.

In addition to that, the abortion should be advised by a Doctor (M.D.) of the respective medical ground. Only then would section 9 of the M B Act, 1961 be applicable.
