Are Our New Office Hours Compliant with Model Standing Orders? Let's Discuss!

Dear All,

Our organization works in a general shift, and if required, we ask our workers to work extra. Presently, management has decided to change the general shift timing from 9.30 am to 6 pm to 9 am to 5.30 pm. The consensus of all employees has been taken before introducing this change. My question is, do these timings form part of model standing orders, and do we need to notify about the time change anywhere else?

With Regards,
Gayatri

Though it's late to reply to you, I want to share the following with you. Yes, you have to inform all your supporting functions, such as vendors and external consultants, about this change in your operations timings. It would be much better if you could display your timings on the notice board.

If you have a certified standing order for your establishment, then you have to amend the relevant provision in the standing order following the due course of procedures required for an amendment. Model standing orders refer to a draft that can be adapted temporarily, for example, for six months from the date on which the Industrial Establishments (Standing Orders) Act becomes applicable to your establishment. Therefore, what needs to be changed are the existing and certified standing orders. Since all employees have agreed to the change, you can easily amend it. Moreover, a notice (at least 21 days before such a change) is required to be circulated regarding the change, as changes in office timing, shift timing, or hours of work are considered changes in service conditions, requiring notice as per section 9A of the Industrial Disputes Act.

Dear Sir, I would like to request a change in my office timing because I am taking an MBA class that starts at 7:00 pm. My current official hours are from 10:00 am to 6:30 pm, which conflicts with my class schedule. Therefore, I would like to change my official timing to 9:00 am to 5:30 pm instead of 10:00 am to 6:30 pm. I would appreciate your permission to make this change.

Thanks,
Ganesh Keshari
