How Should I Handle My Ex-Employer's False Claims and Delayed F&F Settlement?

Dear All, I was working with a leading MNC for the last year. For some personal reasons, I left the company in March 2011. The company accepted my resignation, and I handed over company property. Even today, after two months from my resignation letter, the company has not given me a relieving letter or settled my F&F.

I requested my boss the same, but he ignored me. So, I complained to his higher-ups. My ex-boss is now angry with me and has sent me a letter stating they cannot settle my claims because: 1) I did not hand over company property, and 2) the company suffered huge losses since I did not conduct trials with one of my old customers.

I have proof that I handed over all company property to them, and there were no complaints from any customers while I was on the company's payroll. These stories are fabricated by my ex-boss to delay my F&F claims, which are only Rs. 25,000.

Please Guide Me on What I Should Do

From the letter sent to me, it appears that they are going to sue me in court.

Resignation and Legal Implications

If your resignation is as per the terms of your appointment letter (employment contract) and your resignation letter is officially accepted by the company, then the company cannot sue you on any ground. You should reply to the letter sent by your boss, giving all the facts that you have resigned as per the terms of your appointment letter and that once a resignation is officially accepted, it cannot be rejected. Additionally, provide documented proof that the handover was proper as per the company norms and that you have not breached your employment contract.

As per my appointment letter, the notice period is one month OR one month's salary. I have served a 15-day notice period and have a formal email from my ex-boss accepting the same. I have requested them to deduct 15 days' salary. So, I just want to know if this is in line with the terms. I am okay even if they deduct one month's salary.

Acceptance of Resignation and Notice Period

If your proposal to serve a 15-day notice period and have a deduction of 15 days' salary was officially accepted by your ex-boss, and if he was the authorized person to accept a resignation letter, then now the company or your new boss cannot retract from the earlier acceptance of resignation.
