Can We Offer Compensatory Time Off to Third-Party Contract Workers? Seeking Clarity

Gayatri2505
Our company is currently in its infancy period. We have a combination of employees, including those on the payroll and third-party contract workers (TPC).

The management is considering giving compensatory time off to these blue-collar TPC workers. However, I am unsure if comp. off can be given to workers. I recall reading that comp. off is typically allowed for staff, not workers.

Could someone provide clarification on this matter, please?

Hi Gayatri, please read Section 53 of the Factories Act.

Compensatory Holidays

53. Compensatory holidays. (1) Where, as a result of the passing of an order or the making of a rule under the provisions of this Act exempting a factory or the workers therein from the provisions of section 52, a worker is deprived of any of the weekly holidays for which provision is made in subsection (1) of that section, he shall be allowed, within the month in which the holidays were due to him or within the two months immediately following that month, compensatory holidays of an equal number of the holidays so lost.

Thank you.
