Can anyone help me with the matter relating to ESIC? If an employee has completed online registration on the ESIC website but has not visited the ESIC office for his photograph, can we provide any assistance under ESIC if that person meets with an accident?

The employee who is registered with the Employees' State Insurance Corporation online has not gone to the ESI Office for his photograph. Yes, he is entitled to benefits from the ESI Corporation under the provisions of the Act. If he has met with an accident and the injuries are of a temporary nature, direct him to get his photograph. If the injuries are of a serious nature, then he must produce his temporary card signed by his employer with a photograph. The ESI department will then provide him with treatment.

Thanks, Mukesh. But if, in case, that person has already taken treatment from some hospital and as these people are not financially strong, can we help them with the reimbursement of that money? Maybe not the full amount, but at least a partial amount.

If any employee/person has already received treatment from a hospital and is not financially strong, yes, we can help them on humanitarian grounds. However, legally, as the management, we are not obligated to provide them with any reimbursement for that money. Furthermore, an injured person cannot claim this amount from the ESI Corporation. If they are injured, they can only visit the ESI Dispensary for further treatment and for the encashment of medical leave only.

Thanks a lot for your information about ESIC; it is very helpful for me. I have one more query. If, for example, a person is hospitalized due to a heart attack and is currently on leave, recuperating at home, can they claim sick leave encashment from ESIC? Although their cards are not ready, they are registered online. Could you also please explain the procedure for sick leave encashment from ESIC? Please guide me on this matter.

If an employee is registered under the ESIC Act and payments are being made into that particular person's account, they will surely be eligible to receive benefits under the ESIC Scheme. The employer can attest Form 37 with the company seal and an attested family photo of that particular person in order to receive treatment at an ESIC hospital.

Steps to Ensure ESIC Assistance

Take a 100-page notebook, then attach the employee's photograph to the book and staple the ESIC online application form. ESIC will then provide treatment. Keep Form No. 37 signed by the employer.
