There is one specific format from the labor department; you just need to fill that out and attach the promoter and business details, along with the prescribed fees, and submit it to the labor department. They will stamp it and provide the license copy.

As per my knowledge, you can get the license for a minimum of 5 years, and later it can be renewed for the next 5 years.

First of all, you have to get your blueprint for the factory building plan ready (in quadruplicate) from a professional architect. Ask the architect to complete your factory building plan file and then complete the enclosure of the same. Next, fill out Form No. 2 under the provisions of the Factories Act, 1948, along with the applicable fee and necessary documents. Submit both the files to the Inspector of Factories. The Inspector will first approve your factory building plan, and then grant you the factory license.

Factory License Requirement for Construction Projects

This is Rajesh Dubey from Bihar. I would like to clear my doubts on the following. We have started construction work (civil as well as mechanical) for an edible oil project, and it will take a minimum of 6 months to complete. Once, the factory inspector visited our site and told us to first approve the plan from its office and take a license.

Now, is a factory license necessary to obtain first, or can we proceed with all jobs and then seek approval? Please advise.

Factory Plan Approval and Registration Process

Regarding the question of Mr. Mohd Saud, it is first important to get the approval of the building plan/factory plan under Section 6 of the Factories Act, 1948. For that, see the Factories Rules of the respective state in which the factory falls.

For Plan Approval:

• Form No. 01 with documents like a flow chart of the manufacturing process and building plan/factory plan.

For Registration/License:

• Form No. 02 within 15 days of the occupation of the factory along with the requisite fees as per schedule.

So, Mr. Rajesh, you have to approve your factory plan first along with your construction.

Checklist for Licensing and Registration of Factory

Documents required:

1. Form No. 01 (Application for permission to construct, extend, or take into use any building as a factory)

2. Form No. 1 (Particulars of rooms in the factory)

3. Form No. 3 (Application for registration and renewal of license for the year and notice of occupation specified in sections 6 and 7)

4. Questionnaire

5. Certificate of stability duly signed by the Chartered Engineer/Chartered Architect.

6. Flowchart for the manufacturing process.

7. Write-up chart of the manufacturing process.

8. Resolution passed by the Board of Directors in which one of the Directors has been declared as Occupier or resolution passed by partners in the case of a firm in which one of the partners has been declared as Occupier or declaration of the proprietor in the case of a proprietorship concern.

9. List of Directors/partners.

10. List of machinery.

11. NOC Pollution Control Board.

12. Site plan.

13. Machine layout.

14. Memorandum of articles.

Procedure for Building Plan Approval

First, you apply for building plan approval (in quadruplicate) to the Assistant Director of Factories. Afterwards, you submit the following documents along with the fee:

- Form No. 2
- Form No. 1
- Form No. 1A
- Questionnaire
- Sale Deed / Lease Deed
- List of Directories
- Production Flow Chart
- Memorandum of Articles
- Consent Copy of KSPCB
