Stuck Without Relieving and Experience Letters: Can I Take Legal Action Against My Former Employer?

Please help me!!!

I resigned from my company 3 months ago. However, my reporting manager is not willing to accept my resignation, and the company is refusing to provide me with my relieving and experience letter. I have discussed this issue with the company's HR head and other relevant parties, but no one has responded, not even after escalating the matter to the company director who has also been unresponsive. Due to the lack of these documents, I have missed out on three well-known opportunities even after receiving offers from them. I do not wish to resort to creating fake certificates as this could lead to future problems. Can I take any legal action against them? What should I do?

Actually, my reporting manager told me to resign; he said otherwise they would terminate me without any reason. In fact, I was involved in an accident, and after three days, the doctor advised me to take rest for more than one month. I submitted my resignation on the spot along with all the required documents (x-ray report, medical certificate, prescription), and I even met them face to face to explain the situation. Additionally, I discussed this via email with the HR head. However, since I am no longer a part of that company, they have all come together, and being a large company, they do not seem concerned about their employees' futures. Many employees of the same company are facing similar issues. For example, one engineer working on our site for more than 4.5 years is also suffering from the same problem.

Absolutely right, Abarna Ramesh. I tried the first option because I know the importance of it. But even after many attempts to convey my message, they are not ready to talk, at least on the phone. Whenever I tried to call them, they would disconnect my calls, even when using another phone line.

I am really thankful to you because your second opinion is the best for me. I have all the other documents like the offer letter, payslips, Form 16, and appointment letter. However, when I discussed this with a company that offered me a new job, they informed me that these documents are not enough to meet their company's criteria, and they rejected me. Even after receiving the offer letter, they rejected me. This company is reputed, and if necessary, I can provide you with the company's name and show you the offer letter and email mentioning the reason for my rejection. Please advise on what to do in this situation as I am in dire need of a job.

I understand that this situation is challenging, but I must find a way out of it...

Communicate with Your Previous Employer

Better yet, talk to your old company. You can offer to pay the amount required to compensate for the notice period. If that doesn't work, explain your situation to your current employer.

I have already paid the amount compensating for the notice period and submitted my ID cards from my site. I have completed all the formalities. However, some reputed companies, such as IBM, are not accepting this situation and are not willing to keep me on the job. In my opinion, this is a really bad thing because I am unable to do anything against them as they are misusing their authorities. Are there any legal procedures that can be taken against them so that they will not repeat this behavior with anyone else in the future? I do not want others to face the same kind of problem in that company as I did.
