How Do You Compensate Employees Who Work Every Sunday? Seeking Your Advice!

I am a beginner in Cite HR and also a novice in my career :) But I have the opportunity to work for a private limited company as an HR. I am in the process of setting up the basic HR practices and would appreciate your help and guidance. Currently, I am working on my company's HR manual and would appreciate help in the following area:

Q: If an employee is taking leave on a weekly holiday, compensatory off is being given. But what if an employee is expected to work on all Sundays (weekly off)? How can it be compensated? Please provide your valuable inputs.

Hi there,

As per the Factories Act, 1948, weekly hours and days have been defined.

(1) No adult worker shall be required or allowed to work in a factory on the first day of the week (hereinafter referred to as the said day), unless:

(a) he has or will have a holiday for a whole day on one of the three days immediately before or after the said day, and

(b) the manager of the factory has, before the said day or the substituted day under clause (a), whichever is earlier, -

(i) delivered a notice at the office of the Inspector of his intention to require the worker to work on the said day and of the day which is to be substituted, and

(ii) displayed a notice to that effect in the factory. Provided that no substitution shall be made which will result in any worker working for more than ten days consecutively without a holiday for a whole day.

(2) Where, in accordance with the provisions of subsection (1), any worker works on the said day and has had a holiday on one of the three days immediately before it, that said day shall, for the purpose of calculating his weekly hours of work, be included in the preceding week.

If a worker is deprived of any of the weekly holidays for which provision is made in subsection (1) of that section, he shall be allowed, within the month in which the holidays were due to him or within the two months immediately following that month, compensatory holidays of equal number to the holidays so lost.

Thank you, Vikas, for your inputs. However, the company I work for is not involved in manufacturing. We operate in the service industry, specifically in the education sector. In this sector, how can we compensate employees for the holidays they have sacrificed by working for the company? For example, working on a Sunday for counseling customers when they could have easily taken the day off. What strategies can be implemented to recognize and appreciate such efforts in a service-oriented setting?

Every employee, worker, or laborer is entitled to receive a weekly holiday as per the Factory Act of 1948 and the Weekly Holiday Act of 1942, whether they are working in the service sector or the manufacturing industry.

As per my knowledge, if employees are working on a weekly off or holidays, they can be compensated with leave or monetary benefits. However, the weekly off is the right of every employee and needs to be allocated.
