Am I Entitled to Two Months' Salary if My Company Wants to Relieve Me Early?

gaea_haides
I resigned from my company on the 21st, and as per the company policy, I agreed to serve the two-month notice period. My company, however, wants to relieve me in 10 days' time (end of the month). What I need to know now is, am I eligible for a 2-month salary compensation?

Offer Letter Clause on Resignation

Here is what my offer letter says:

"Resignation: In the event of your deciding to resign from the services of the company, you will have to give two months' notice to the company or pay the company an amount equal to your two months' gross emolument, in lieu of the notice. The date of relief will be at the discretion of the company."

I hope this helps clarify the situation for you.

As the last line comments, "the date of relief will be at the discretion of the Company." So, as far as I am concerned, you cannot claim the compensation.
