Is Workmen's Compensation Policy a Must for Small Firms Like Ours in Mumbai?

Workmen's Compensation Policy Requirement

Our small private limited firm, with only 3 employees (but part of a very large real estate group) in Mumbai, is involved in facility management services. We do not have ESI due to high pay and low manpower.

Is it mandatory for us to have a workmen's compensation policy? If so, what are the policies and companies that provide it? Is there any abstract or notification from the government to support this?

As per the definition of an employee, those employed in the construction, maintenance, repair, or demolition of any building, which is designed to be or is or has been more than one story in height above the ground or twelve feet or more from the ground level to the apex of the roof, are included. Facility Management will come within the meaning of Maintenance.

It is better that you take out the policy. In case the insurer, i.e., the insurance company, is not offering it, then you can go in for an Accident Benefit Policy.

I fully agree with Praveen's comment. If the employees are without ESI coverage, they should be covered under a WC policy.
