TN Industrial Establishments (National & Festival) Act, 1958
Important Points
1) Employee means: Any person (including an apprentice) employed in any industrial establishment for manual, supervisory, technical, or clerical work for hire or reward, whether the terms of employment are expressed or implied.
2) Every employee shall be allowed in each calendar year a holiday of one whole day on the 26th January (Republic Day), 1st May (Labour Day), 15th August (Independence Day), and 2nd October (Gandhi Jayanthi) and five other holidays.
3) Where an employee works on any holiday allowed under section 3, he shall, at his option, be entitled to twice the wages or a substitute holiday with wages on one of the three days immediately before or after the day on which he works.
4) This act shall not apply to any employee in a managerial position or any employee whose work involves traveling.
Important Forms:
Form 1
Every employer shall, within 30 days from the date of commencement of work if they are a new industrial establishment, send in duplicate together with a copy of the notice to the Inspector.
Form II
Objections or suggestions, if any, to the proposal of the employee shall be sent to the Inspector within 15 days.
Form V
Every employer shall send to the Inspector before December 31st. Every employer shall exhibit this copy on the notice board.
