I am working in a software service Indian-based Pvt Limited company. From the date of joining until now, the Employer never revealed gratuity benefits in my offer letter or appreciation letter for 4 years, nor did they deduct it, but they are deducting PF. Now, I am about to complete 5 years of experience with the company. As per the rule, if a Pvt Ltd company has more than 10 employees, the Pvt Limited company is mandated to give gratuity to employees who have completed 5 years.
My doubt is, until this Pvt Limited company declares officially, will it be applicable, or should Pvt Limited companies basically grant gratuity benefits? Please clear my doubt.
