Struggling to Withdraw PF from a Previous Employer: How Can I Complete My Final Settlement?

Hi,

I worked for an organization for 1.5 years from 2005 to 2006. After I joined another organization in 2009, I sent Form 19 to my first employer. They immediately sent me a clearance certificate for final settlement. However, to date, I have not sent them this form. When I communicate with them, they tell me to complete my final settlement before they release my PF. What should I do?

Now you need to do one thing. Take a printout of each of Form 19 and Form 10C (print on both sides of the respective forms), fill in the particulars of your employment including your PF number (I assume you know your PF number), and get the forms attested by the Manager of the Bank to which you want to transfer the PF accumulations. Attach a canceled cheque leaf (to facilitate electronic transfer of funds by the PF) and submit the same to the Provident Fund Office where your company's PF accounts are maintained. The amount will be credited to your account without any signature from your employer.

Dear Madhu,

I have submitted my PF form (duly signed by a gazetted officer), but it got rejected citing the reason that the authorized official's signature does not match the office record. Now, I have submitted:

1. Form 19 (signed by the gazetted officer - one signature on the second page)
2. Form 10C (Signed by the gazetted officer - one signature on 'signature of employer/authorized official')
3. Bank statement

Kindly help me to understand the problem.

Some more info: I quit on 2nd Feb 2008 and am claiming now as my employer refused to sign my PF form.

Hi Madhu,

I have contacted the PRO of RPFO Jaipur (0141-2742699), and he said the rule has changed. Now, the withdrawal forms have to be duly authorized by the employer if the unit employed is still running.

When I mentioned that on the 19C, it's written that any gazetted officer can authorize the withdrawal form, he replied that the forms are old and have not yet been updated to the new version. However, the form has to be authorized by the employer only.

Now, I am confused. Do you have any idea about the new rule?

The rule has not been changed, I believe. I also know that there are officers in the EPFO who refuse to accept forms, but all have very strong personal and financial relationships with certain employers. Due to this, they reject forms signed by bank managers or gazetted officers. You may do one thing, ask him to quote the notification that makes the employer the sole authorized person to sign Form 19 and 10C. If you state that you would otherwise file an application under the Right to Information Act, I think the answer may be different.

Anyway, if the rule authorizing a gazetted officer, bank manager, MLA/MP, etc., to sign Form 19 and 10C has changed, please let us know.
