Good effort. But I have a doubt. As per the Workmen's (Employees) Compensation Act, there is a minimum compensation of Rs. 120,000 for death and Rs. 140,000 in case of permanent total disability. Similarly, the salary is subject to a maximum of Rs. 8,000, and there is provision for calculating compensation based on the statutory minimum rates of wages. I think the sheet takes into account the actual salary and not the minimum compensation. Please correct me if I am wrong.

Dear Javedalam,

Good efforts. One more change is required: if an employee has a disability in the middle ring finger, middle finger, and index finger, then the total of this should be included in the formula, which is currently not being accounted for. Please check.

Also, please explain the "Category of compensation."

Regards,
Madhukar
JAWEDALAM
Dear R. Parveen Kumar,

The changes suggested by Mr. Madhu T. K have already been incorporated in this new "Workmen's Compensation Calculator1 (New).xls". Please check this new file.

Dear Madhukar,

"Category of compensation" = in case of Permanent Total Disablement (60%), in case of death it is (50%) just for calculation purposes.

If an employee has a disability in the middle ring finger, middle finger, and index finger, then that disablement will not come under Schedule I and will be treated as Permanent Partial Disablement (Not covered under Schedule I). The doctor will decide the % of loss of earnings. This calculation is also incorporated in the 2nd sheet "COMPENSATION PPD BY DOCTOR". Please check it.

Jawed Alam

Dear All,

Is there anyone who can help me with converting numbers to text in an Excel sheet? For example, when I type 5, it should automatically display as "Five," or when I input 5000, it should show as "Five Thousand."

Thanks,

Dear Sir,

My son, who is a Mechanical Engineer, met with an industrial accident while working in a factory. He sustained a pelvic fracture, urinary bladder rupture, and compression in his L5. As a result of this accident, he is unable to walk normally. His current health status includes partial sensory loss in the right leg fingers, sciatica with right leg foot drop. I would like to inquire if he is entitled to compensation and, if so, how much. He is currently earning a salary of 18,000/- per month, and he is 24 years old.

If any Managerial cadre employee or Supervisor cadre employee meets with a fatal accident or permanent disabling accident, are they eligible for any type of compensation under any act? Please reply.
Madhu.T.K
The Employees' Compensation Act does not restrict compensation to workmen as defined in the ID Act, and as such, all employees are covered under the Act.

Dear Mr. Javed Alam,

The calculation sheet is really very useful; thank you very much for sharing. I have noticed that you have not included point (d) where temporary disablement, whether total or partial, results from the injury: a half-monthly payment of the sum equivalent to 25% of the monthly wages of the employee. This is in the case of the injured employee's monthly salary to be paid.

Hello sir,

I have a doubt related to Workmen's compensation. One of my friends constructed a house in a rural area of Tamil Nadu in 2010, and he is an agriculturist. With a lot of difficulty, the housework was completed. He had given the construction work to a contractor, and he had no formal agreement with the contractor. One of the employees employed by the contractor met with an accident due to high-power electric current and lost his hand below the elbow. Medical charges were taken care of by both my friend and the contractor. Unfortunately, it is of no use. Now, as per the Workmen's Compensation Welfare Commission, he has to pay 5.95 Lakhs and an interest of 12% from the date of the accident. So, the total amount to pay is 10L. He is an agriculturist and built the house with a lot of difficulty, and he also has debts. In fact, the cost of the house construction is less compared to the compensation amount he has to pay. He spent only 6L on the house. Please advise on the procedure. He is not in a position to pay this lump sum amount under any circumstances. Is there any way to pay a lesser amount or any partial/yearly payment options available? Your help is greatly appreciated.

Thanks,

Can you please clarify if the monthly wage is less than 8000/-, then do we have to consider the actual wages or Rs. 8000 for calculation purposes?
Madhu.T.K
In case the actual wages are less than 8000, you can take the actual wages. However, the actual wages should not be less than the statutory minimum wages.

The Excel sheet is very helpful. I have calculated based on the following details:

Employee's age - 35 years
Factor - 197.06
Salary Rs. 9500/- but for the purpose of calculation the maximum limit is Rs. 8000/-
Nature of injury - Permanent partial disablement as mentioned in Part II of Schedule I in serial no. 35 (ring or little finger - whole) with a percentage of loss of earning capacity as 7%

As per the calculation from the Excel sheet (NEW), it is showing Rs. 82,765/- under the heading "compensation ppd by doctor".

Can anybody tell me what is the formula/basis of the calculation and is it right? Thanks in advance.

Dear Sir,

If a worker is attending duty an average of 15 to 16 days every month due to health issues, and now has had an accident resulting in permanent disability, how do we calculate the compensation wages? Additionally, should we include HRA, conveyance, LTA allowance, etc., in the wages?

I need your help.
