Can an Employee Take Privilege Leave for LTA While Still Working Due to Project Load?

Hello All, One of our employees wants to avail Privilege Leave sometime in the month of February. This is to claim the LTA amount for the year 2011. However, the issue is that he wants to avail leave for the LTA purpose while he will be working in the office due to project workload.

Is it possible to allow such a situation, and should HR approve such leave?

In that case, the LTA amount is taxable. It can be allowed. Many companies are following this practice.

You can ask the employee not to avail the PL. Get the LTA claim form filled and obtain his HOD/HR Manager's/GM's/VP's signature (whoever is in charge) with a note that he cannot go on leave due to workload, etc. This way, he can claim his LTA and also save his leave. Also, the amount will be taxable as mentioned by Ponraj.
